On March 28, Alston & Bird Partner Nanci Weissgold and Senior Associate Anoush Garakani issued a Client Alert summarizing a Massachusetts court case relating to debt collection activities and communication efforts with a debtor in the collection of consumer debt, specifically when contacting a debtor by telephone in accordance with 940 CMR 7.04(1)(f).   The Client Alert identifies what actions are deemed an attempt to contact a debtor via telephone to collect on a consumer debt in the Commonwealth, and informs and warns clients of the serious implications of this decision and the potential risks of significant penalties for violations of the Massachusetts Attorney General’s (“AG”) debt collection regulations (940 CMR 7.00) and corresponding guidance on the AG’s regulations.
